Warranty Policy – SD Retrogames

At SD Retrogames, we are passionate about retro games and strive to offer you products that work as expected. Since our assortment consists of second-hand goods, we apply the following warranty policy in accordance with applicable consumer legislation in Belgium.
1. Legal Warranty Period
For all second-hand retro games purchased from us, a legal warranty period of one (1) year applies for any lack of conformity.
This warranty period starts on the date of delivery of the product.
2. What Is Covered by the Warranty?
The warranty covers a “lack of conformity.” This means the product does not match the description we provided or does not have the features you could reasonably expect.
Examples include:

A game that doesn’t start

A game that crashes during normal use (not due to the console)

An accessory that does not function as described
The warranty only covers defects that already existed at the time of delivery and become apparent within the one-year warranty period.
3. What Is NOT Covered by the Warranty?
Given the nature of second-hand retro games, the following are excluded from warranty:

Normal signs of use: Scratches, slight discoloration, wear on boxes or manuals that do not significantly affect the functionality of the game and are inherent to the age and previous use of the product.

Specifically described defects: Defects or imperfections clearly stated in the product description and known at the time of purchase (e.g., "box damaged", "manual missing", "sticker on cartridge").

Damage caused by the buyer: Defects occurring after delivery due to misuse, accidents (such as drops, impacts, water damage), neglect, improper storage, or self-modification/opening of products.

Compatibility issues: Problems arising from use on non-original or modified consoles, or with unusual adapters/peripherals, unless otherwise stated.

Battery lifespan: Internal batteries in game cartridges (e.g., for saving game progress) are not covered by the warranty, as their lifespan depends heavily on age and prior use. We test the save function where possible but cannot guarantee its future duration.
4. How to File a Warranty Claim?
If you believe a defect covered by the warranty has occurred, contact our customer service as soon as possible at info@sdretrogames.com, preferably within two (2) months of discovering the defect.
Please clearly state:

Your order number

The product name
-
A detailed description of the problem
Photos or a short video can help clarify the issue.
Do not return the product until you have received instructions from us. We will assess your claim and inform you of the next steps, including any return procedures.
5. Remedies for a Valid Claim
If the defect falls under warranty, you are entitled to an appropriate remedy. According to legislation and depending on the situation, we will provide one of the following:

Repair: If feasible and economically reasonable

Price reduction: A partial refund corresponding to the diminished value caused by the defect

Contract termination: Full refund upon return of the defective product
The choice of the most suitable remedy will be made in consultation, but the final decision rests with SD Retrogames, in accordance with legal guidelines.
6. Burden of Proof

For defects that appear within the first six (6) months after delivery, it is assumed that the defect existed at the time of delivery, unless we can prove otherwise (e.g., clear user damage).

For defects that appear after the first six (6) months (but within the one-year warranty period), the buyer must prove that the defect already existed upon delivery and was not caused by use after delivery.
